Tachodisc has announced that they will be hosting a series of seminars in 2008 to inform operators and drivers on new and forthcoming legislation. The seminars will focus on four key areas:
1. Corporate Manslaughter and Corporate Homicide Act 2007 ---
Under this new legislation, which will be introduced on 6th April 2008, a corporate body rather than an individual can be convicted for causing a person’s death. The consequences can be an unlimited fine, which emphasises the importance of an operator having effective, managed procedures in relation to Drivers Hours’, vehicle defect reporting, vehicle maintenance, health and safety, and comprehensive risk assessments.
2. Driver CPC
This will come into effect for PCV drivers in September 2008, and September 2009 for LGV drivers. The new regulations stipulate that a driver will have to undertake 35 hours of compulsory training over a five year period, delivered in at least 7 hour blocks. A predetermined syllabus will be followed, which can only be delivered by accredited training centres and trainers.
The introduction of Driver CPC is designed to improve road safety, fuel management and vehicle efficiency.
3. Operator Compliance Risk Score
Currently in operation, is a score matrix scheme that is managed by VOSA to target non compliant operators based on vehicle road worthiness and non mechanical offences.
Companies are allocated a colour status of green, amber or red. Every operator will have a score based on either historic or predictive data and by using hand held mobile devices linked to the data base VOSA can target operators with red indicators.
4. Graduated Fixed Penalty Scheme - Expected to be introduced 2009 - Under Consultation
To establish consistency in fines, and speed up the enforcement process, a new graduated fixed penalty scheme is being proposed for commercial vehicles whose offences relate to operating rules. There will be four bands of offences and penalties, which will be graduated accordingly, depending on the severity.
